Overview

IA investigations are the most scrutinized process in any department — and among the most regulated. Department policy, city and county rules, state law, and officer rights statutes all govern how these investigations must be conducted. Every decision is watched — by the officer, the union, administration, the courts, and the community. Get the process wrong and everyone pays for it. Get it right and the process does what it is supposed to do: find the truth, apply the rules fairly, and reach a conclusion that holds.

Third Degree Training founded the first private-sector Internal Affairs training in the Western States in 2013. We built the original course and have refined it every year since, working with IA investigators, command staff, union leaders, and officer representatives across the United States. We know this landscape from every angle — because we train every angle.

What separates this course is the legal day. We partner with each state’s top police defense law firm or SME attorney to dedicate a full day to current case law — POBR, Garrity, Lybarger, officer rights, parallel investigations, and defensible findings. No other IA training in the country does this. It is the day that changes what every person at the table understands about how these investigations must be conducted.

We are not advocates for administration or for the union. We are advocates for process done right — thorough investigations, protected rights, and conclusions that hold up to scrutiny from every direction.

Four Sides of the Table: The Officer. Administration. The Union. The Attorney. IA investigations are highly regulated — department policy, city and county rules, and state law all require process to be followed precisely. When all four sides understand the same standards and the same law, the process works the way it is supposed to — less friction, stronger investigations, protected rights, defensible conclusions.

This is a three-day, 24-hour course — the most comprehensive IA training available in the Western States. Here’s how it is structured:

  1. IA Foundations & Investigation Process: Organization, function, attitude, complaint intake, initial assessment, complainant interviews, evidence identification, witness interviews, and the full case management framework from complaint through adjudication.
  2. Interview Planning, Officer Rights & Report Writing: Identifying witness vs. subject officers, preparing IA-specific interview questions, conducting officer interviews, navigating POA rep interactions, writing defensible IA reports, and managing special investigations.
  3. Full Day — Police Defense Attorney: Case Law & Legal Standards: A complete day with top police defense law firm attorneys. POBR history, purpose, and application. Garrity and Lybarger admonitions. Officer rights in criminal vs. administrative investigations. Parallel investigation management. Statute of limitations. Pre-interrogation discovery. Findings, disposition, and confidentiality of personnel records. This is the day that separates this course from every other IA training available.

IA investigations are the departments solve culture applied to the institution itself. Not solving crimes — solving the barriers that undermine trust, accountability, and the department’s ability to function at its best. A well-run IA process protects the good officer from a bad complaint, holds the officer who crossed the line accountable, and shows the community that the department polices itself with the same rigor it brings to everything else. That process has to be correct. That’s what this course teaches

Jeff Profio
Jeff Profio currently serves as Police Chief for the Prineville Police Department in Central Oregon. Jeff started his law enforcement career with the San Jose Police Department and served for 25 years, retiring as a Lieutenant. While at SJPD, he was assigned to Internal Affairs, the SJPD MERGE Team (SWAT), the Robbery Investigations Unit, the Vice Unit, the Covert Response Unit, and as a Field Training Officer. After retiring from SJPD, Jeff served as lieutenant for the West Valley Mission Community College Police Department for four years. Jeff is also a certified POST Master Instructor.‍

Mike Rains holds a Bachelor of Arts magna cum laude in English Literature from California State University at Long Beach. While serving as a police officer in the City of Santa Monica, he received a scholarship to attend law school. He earned his Juris Doctorate summa cum laude at Golden West University School of Law and then entered private practice, leaving police work in 1980.‍ Mike worked for 18 years at the San Francisco-based law firm of Carroll, Burdick & McDonough and founded Rains Lucia Stern, PC in May 1999. The firm emphasizes representation of public safety personnel in administrative, disciplinary, civil, criminal and labor-related issues. Mike has over 30 years of experience representing police officers and other high-profile clients in civil and criminal litigation.

Julia has significant legal experience, including nearly eight years at the San Mateo County District Attorney's Office as a Deputy District Attorney, spending much of her time in a felony trial unit. She is a highly experienced trial lawyer who comes from a police family: her father, brother, and husband are all cops. Andrew defends public sector employees in criminal matters, administrative investigations, critical incident investigations, and disciplinary appeals. He also represents public sector employees in disciplinary actions and related litigation. Prior to joining RLS, Andrew worked as a prosecutor for over 13 years, handling virtually every type of criminal matter. He has the distinction of being named Solano County's first ever "Prosecutor of the Year." In San Francisco, Andrew spent most of his time in the homicide unit, handling several complex cases. He has conducted well over 100 jury trials individually, written and argued countless motions, conducted many hundreds of preliminary hearings, presented cases to grand juries, handled writs and appeals, represented the State in parole hearings, and delivered several trainings to lawyers, law enforcement, and criminalists.‍

What I liked best were the videos, and the information regarding Miranda was especially valuable. This class is awesome — I think you need to push very hard to make SJPD make this interview and interrogation course mandatory for officers and detectives around the 3+ year mark. Preliminary investigations would be so much more successful and beneficial to BOI investigators. This is an excellent course.
What I liked best were the Miranda scenarios and discussions. The Instructors are professionals who have more combined experience than most agencies. They are passionate about this subject and make the course and material fun. I feel like you could take this class 100 times and still learn something new each time.

What I liked best was the wide variety of fraud-related examples and the proper procedures for investigating them — and it was not Death by PowerPoint. This course is perfect for new detectives and patrol officers wanting to learn more about fraud investigations.
What I liked best was watching real-life videos (body cams) and determining what, if any, warrants could be issued. I also found it very helpful that the instructor was very patient and very willing to help with writing the practice warrants. I really enjoyed his positive attitude in teaching new officers like myself how to write a warrant effectively by using the Hobbs.
Your class was one of the most impactful trainings I've attended. I learned new skills, best practices, and had a few revelations about myself. Your level of preparation, commitment, and professionalism was excellent.
